These Terms set out the rights and obligations of all BIKEPHILOSOPHY users, in relation to the products and services we offer through our website WWW.BIKEPHILOSOPHY.ES
These Terms are important to both you and us as they are designed to create a legally binding agreement between us protecting your rights as a customer and our rights as a business.
Please read these Terms and our Privacy Policy carefully before confirming your payment to place your order.

These Terms may be amended and you should read them before placing each order.

You are also obliged to provide us with your e-mail address, postal address and/or otros contact details and aware that we may use this information to contact you if necessary (see our Privacy Policy). If you do not provide us with all the information we need, we will not be able to process your order.

The contract for the purchase of a product(s) between us (Contract) will be formed only when we send you that Dispatch Confirmation.
Only those products listed in the Dispatch Confirmation shall be subject to the Contract. We will not be obliged to supply you with any other products that may have been ordered, until we confirm the dispatch of the same to you in a separate Dispatch Confirmation.

Service Availability: Items offered through this website will only be available in mainland Spain.
Product availability: BIKEPHILOSOPHY S.L. will make every effort to please all its customers in the demand for the products. However, all orders for products are subject to availability and, in this regard, if there are difficulties in terms of supply, or if there are no items left in stock, we reserve the right to provide you with information about substitute products of equal or higher quality and value that you may order. If you do not wish to place an order for these replacement products, we will refund any amount you may have paid.
-. Delivery
Delivery of the products:
BIKEPHILOSOPHY S.L. undertakes to deliver the products in perfect condition to the delivery address that you include in the order form provided that the brand's commercial policy allows their shipment
Items with shipping restriction:
Products to which their manufacturer applies a shipping restriction are indicated in the online store www.biciescapa.com with the delivery type: "In-store pickup only" or "Physical store delivery only" or "Store only"
Under no circumstances will any of these products be delivered to carriers or transport companies.
Products without shipping restriction:
You can request the delivery of the items, at another address and to another natural person different from the one who subscribes the order, as long as the delivery address is located in mainland Spain or the Balearic Islands.
Orders will not be delivered to P.O. Boxes.
In order to optimize delivery, please provide an address to which the order can be delivered within normal business hours.
BIKEPHILOSOPHY S.L. makes its shipments through courier companies
The delivery of the goods will be made to the address designated by you. In the event of the absence of the recipient, at the time of delivery, a receipt will be left indicating how to proceed to arrange a new delivery.
BIKEPHILOSOPHY S.L. reserves the right to vary the type of shipment and the company by which it is made, regardless of what is stated on these pages and provided that it does not involve a manifest detriment to the customer.
The shipping costs derived from the shipments of the purchased items will be reflected at the final time of purchase and will depend on the place of destination. These conditions may be modified.
For the purposes of these Terms, "delivery" or "delivery" shall be deemed to have taken place or the product(s) to have been "delivered" at the time of signing for receipt of the product(s) at the agreed delivery address.
Delivery times:
BIKEPHILOSOPHY S.L. tries to have adequate stock of all the products offered in order to make deliveries in less than 5 working days, but on certain occasions due to failures in the supply chain (manufacturers, distributors, logistics operators), it is not possible to meet this deadline.
The estimated delivery time is detailed on each product (the days are always working days, not counting weekends, holidays or long weekends). For shipments to the Balearic Islands, 2 working days must be added to the indicated period.
If, once the purchase has been made, one of the purchased products cannot meet the delivery deadline, BIKEPHILOSOPHY S.L. undertakes to inform you and propose an alternative to the purchased product. If you are not satisfied with the new deadline and/or the alternative, we will cancel the order and if you have made the payment, we will refund it.
Under no circumstances will BIKEPHILOSOPHY be held responsible for possible delays in delivery by the transport agency.
If for any reason we are unable to meet the estimated delivery date, we will inform you of this circumstance and give you the option of going ahead with the purchase by setting a new delivery date or cancelling the order with a full refund of the price paid. Please note in any case that we do not deliver on Saturdays or Sundays.
Impossibility of delivery:
We reserve the right to remove any Product from our website at any time and/or to remove or modify any material or content on it. Whilst we will endeavour to always process all orders, there may be exceptional circumstances which require us to refuse to process any order after we have submitted the Order Confirmation, and we reserve the right to do so at any time, at our sole discretion.
We will not be liable to you or any third party for removing any product from our website WWW.BIKEPHILOSOPHY.ES, whether or not such product has been sold, removing or modifying any material or content on the website, or for refusing to process an order once we have sent you the Order Confirmation.

The prices on the website WWW.BIKEPHILOSOPHY.ES inclusive of VAT, applicable on the day of the order, but exclude shipping costs, which will be added to the total amount due.
The PRICE OF THE PRODUCTS will be as shown on the website. The price is expressed including taxes, as these taxes are fixed on the date of acceptance of the offer. The price must be paid in full at the time of purchase.
BIKEPHILOSOPHY S.L. reserves the right to modify the sales prices shown in WWW.BIKEPHILOSOPHY.ES at any time, but the items will be invoiced based on the rates in force at the time the order is registered subject to availability on that date
-. Return Policy
Returns in exercise of the right to withdraw from the purchase
All products purchased in WWW.BIKEPHILOSOPHY.ES may be returned and refunded, provided that you notify us of your intention to return the product(s) purchased within a maximum period of 14 working days from the date of delivery and that the rest of the conditions established in this section are met.
BIKEPHILOSOPHY will only accept returns that meet the following requirements:
1. The product must be in the same condition in which it was delivered and must retain its original packaging and labelling.
2. The shipment must be made using the same box in which it has been received to protect the product. In the event that it cannot be obtained with the protective box with which it was delivered, the CUSTOMER must return it in a protective box so that the product arrives at the BIKEPHILOSOPHY S.L. warehouse with the maximum possible guarantees.
3. A copy of the delivery note must be included in the package, which also marks the returned products and the reason for the return.
After examining the item, we will inform you if you are entitled to a refund of the amounts paid, for the item(s) purchased. ONLY the amount of the item(s) will be refunded, NEVER the cost of shipping, refund and gift packaging.
The return will be made as soon as possible and, in any case, within 30 days from the date on which you notified us of your intention to withdraw. The refund will be made to the same credit card that was used to pay for the purchase, in the case of purchases by Card or by bank transfer, for orders placed by transfer. You assume the cost and risk of returning the products to us as set out above.
Products that are not in the same condition in which they were received, or that have been used beyond the mere opening of the product or those personalized items, will not be exchanged or returned.
These provisions do not affect the rights recognised to the consumer by current legislation.
Returns of defective products
In cases where you consider that at the time of delivery the product does not comply with the provisions of the Contract, you must contact us immediately through our contact form or by email info@bikemarbella.com , providing the details of the product as well as the damage it suffers, In some cases we will ask you to send us a photo of the damage.
Once the notification has been received, the steps to follow are:
You must return the product to us at the address indicated on the invoice you will receive by post, providing us with the following information:
1. Personal Data

3. Order Number
4. Reason for return
5. Order Receipt Date
Return Date
Please return the item using its original packaging in addition to any instructions, documentation and packaging that may accompany it.
Once we have received the goods to be returned, we will carefully examine the returned product and will notify you by e-mail within a reasonable time if it is appropriate to return or replace it (if applicable). The return or replacement of the item will be made as soon as possible and, in any case, within 30 days of the date on which we send you an email confirming that the return or replacement of the non-conforming item is appropriate.
In the event that the product(s) cannot be replaced, the amounts paid for those products that are returned, due to any defect or defect, where it actually exists, will be refunded to you in full, including the delivery costs incurred to deliver the item to you and the costs you would have incurred in returning it to us.
Returns and partial cancellations will result in partial refunds, of the total amount paid for the entire order. The costs of transport, reimbursement and gift packaging will not be refunded in case the return is partial.
The refund will be made to the same credit card that was used to pay for the purchase or by bank transfer for orders paid for by refund.
