1. Order

The fact that you place an order in www.bikephilosophy.es is equivalent to your full acceptance of the prices, the description of the products for sale and the general conditions of purchase, which will be the only ones applicable to the contract thus concluded. You agree to only use the Website to make legally valid inquiries or orders. You are also obliged to provide us with your e-mail address, postal address and/or otros contact details and you are aware that we may use this information to contact you if necessary (see our Privacy Policy). You warrant to us that you are fully authorised to use the payment card, should you choose such payment method. Only persons with the legal capacity to enter into contracts relating to the class of goods and services offered on this website may place orders on www.bikephilosophy.es

The contract for the purchase of a product(s) between us (Contract) will be formed only when we send you that Dispatch Confirmation. Only those products listed in the Dispatch Confirmation shall be subject to the Contract. We will not be obliged to supply you with any other products that may have been ordered, until we confirm the dispatch of the same to you in a separate Dispatch Confirmation.

2. Availability

Service Availability: Items offered through this website will only be available in mainland Spain. Product availability: BIKE PHILOSOPHY S.L. will make every effort to please all its customers in the demand for the products. However, all orders for products are subject to availability and, in this regard, if there are difficulties in terms of supply, or if there are no items left in stock, we reserve the right to provide you with information about substitute products of equal or higher quality and value that you may order. If you do not wish to place an order for these replacement products, we will refund any amount you may have paid.

3.Prices

The prices on the website www.bikephilosophy.co.uk include VAT, applicable on the day of the order, but exclude shipping costs, which will be added to the total amount due. The PRICE OF THE PRODUCTS will be as shown on the website. The price is expressed including taxes, as these taxes are fixed on the date of acceptance of the offer. The price must be paid in full at the time of purchase.  BIKE PHILOSOPHY S.L. reserves the right to modify at any time the sales prices shown in www.bikephilosophy.es, but the items will be invoiced based on the rates in force at the time the order is registered subject to availability on that date

4. Return Policy

4.1. Returns in exercise of the right to withdraw from the purchase;

All products purchased on www.bikephilosophy.es may be returned and refunded, provided that you notify us of your intention to return the product(s) purchased within a maximum period of 14 working days from the date of delivery and that the rest of the conditions established in this section are met. 4.1. BIKEPHILOSOPHY will only accept returns that meet the following requirements:

1. The product must be in the same condition in which it was delivered and must retain its original packaging and labelling.

2. The shipment must be made using the same box in which it has been received to protect the product. In the event that it cannot be obtained with the protective box with which it was delivered, the CUSTOMER must return it in a protective box so that the product arrives at the BIKEPHILOSOPHY S.L. warehouse with the maximum possible guarantees.

3. A copy of the delivery note must be included in the package, which also marks the returned products and the reason for the return. After examining the item, we will inform you if you are entitled to a refund of the amounts paid, for the item(s) purchased. ONLY the amount of the item(s) will be refunded, NEVER the cost of shipping, refund and gift packaging. According to e-commerce regulations, the refund must be made within a maximum period of 14 days from the time the customer exercises the withdrawal.

The refund will be made to the same credit card that was used to pay for the purchase, in the case of purchases by Card or by bank transfer, for orders placed by transfer. You assume the cost and risk of returning the products to us as set out above. Products that are not in the same condition in which they were received, or that have been used beyond the mere opening of the product or those personalized items, will not be exchanged or returned. These provisions do not affect the rights recognised to the consumer by current legislation.

4.2. Returns of defective products

In cases where you consider that at the time of delivery the product does not comply with the provisions of the Contract, you must contact us immediately by means of our contact form or by email shop@bikephilosophy.es , providing the details of the product as well as the damage it suffers, In some cases we will ask you to send us a photo of the damage. Once the notification has been received, the steps to follow are: You must return the product to the address indicated on the invoice that you will receive by mail, providing us with the following information:

  1. Personal data
  2. Your e-mail address
  3. Order Number
  4. Reason for return
  5. Order Receipt Date
  6. Return Date

Please return the item using its original packaging in addition to any instructions, documentation and packaging that may accompany it. Once we have received the goods to be returned, we will carefully examine the returned product and will notify you by e-mail within a reasonable time if it is appropriate to return or replace it (if applicable).

According to e-commerce regulations, the refund must be made within a maximum period of 14 days from the time the customer exercises the withdrawal. In the event that the product(s) cannot be replaced, the amounts paid for those products that are returned, due to any defect or defect, where it actually exists, will be refunded to you in full, including the delivery costs incurred to deliver the item to you and the costs you would have incurred in returning it to us. Returns and partial cancellations will result in partial refunds, of the total amount paid for the entire order. The costs of transport, reimbursement and gift packaging will not be refunded in case the return is partial.

5. Delivery

Delivery of the products:
BIKEPHILOSOPHY S.L. undertakes to deliver the products in perfect condition to the delivery address that you include in the order form provided that the brand's commercial policy allows their shipment.

5.1. Items with shipping restriction:

Products to which the manufacturer applies a shipping restriction are indicated in the online shop "www.bikephilosophy.es" with the delivery type: "in-store pick-up only" or "physical delivery only" or "in-store only" Under no circumstances will any of these products be delivered to carriers or transport companies.

5.2. Products without shipping restriction:

You may request the delivery of the items to another address and to other individuals other than those who sign the order, as long as the delivery address is located in mainland Spain or the Balearic Islands.

In order to optimize delivery, please provide an address to which the order can be delivered within working hours. Orders will not be delivered to P.O. Boxes. BIKE PHILOSOPHY S.L. makes its shipments through courier companies.

The delivery of goods will be made to the address designated by you, in case of absence of the recipient at the time of delivery, a receipt will be left indicating how to proceed to arrange a new delivery. BIKE PHILOSOPHY S.L. reserves the right to vary the type of shipment and the company by which it is made, regardless of what is stated on these pages and provided that it does not involve a manifest damage to the customer.

The shipping costs derived from the shipments of the purchased items will be reflected at the final time of purchase and will depend on the place of destination. These conditions may be modified. For the purposes of these conditions, it will be understood that the "delivery" has taken place or that the product(s) have been "delivered" at the time of signing for the receipt of the same at the agreed delivery address.

6. Delivery Time:

BIKEPHILOSOPHY S.L. tries to have adequate stock of all the products offered in order to make deliveries in less than 5 working days, but on certain occasions due to failures in the supply chain (manufacturers, distributors, logistics operators) it is not possible to meet this deadline.

The estimated delivery time is detailed on each product (the days are always working days, not counting weekends, holidays or long weekends ). For shipments to the Balearic Islands, 2 working days must be added to the indicated period. If, once the purchase has been made, one of the purchased products cannot meet the delivery deadline, BIKE PHILOSOPHY S.L. undertakes to inform you and propose an alternative to the purchased product. If you do not meet the new deadline and/or the alternative, we will cancel the order and if you have paid, we will refund you. Under no circumstances will BIKE PHILOSOPHY S.L. be held responsible for possible delays in delivery by the transport agency.

If for any reason we are unable to meet the estimated delivery date, we will inform you of this circumstance and give you the option of going ahead with the purchase by setting a new delivery date or cancelling the order, with a full refund of the price paid. Please note that in any case we will not deliver on Saturdays or Sundays.

7. Impossibility of delivery:

We reserve the right to remove any product from our website at any time and/or to remove or modify any material or content on our website. Whilst we will endeavour to always process all orders, there may be exceptional circumstances which require us to refuse to process an order after we have sent confirmation of the order, and we reserve the right to do so at any time, at our discretion.

We will not be liable to you or to any third party for removing any product from our website www.bikephilosophy.es, whether or not such product has been sold, removing or modifying any material from the website, or for refusing to process an order once we have sent you your order confirmation.
